Dear Janice,
Find out the reasons for your Homeowner Association's policy. Once they understand that you have specific plans for a garden (a vegetable garden I assume) they may grant you a variance. If you want to have a landscaped area, and not a garden per se, then plant appropriate native plants under your existing trees and enjoy the woods you will have created...a truly natural garden that will benefit wildlife.
